1. Introduction
This Privacy Policy describes how Acumenly ("we", "us", or "our") collects, uses, and shares information when you use our software platform and related services (the "Service"). By using the Service, you agree to the practices described here.
2. Information We Collect
We collect the following categories of information:
- Account information you provide when signing up: name, work email address, password (stored hashed), and the agency you represent.
- Agency information entered during setup: legal name, DBA, agency affiliation, operating states, primary location, and primary phone number.
- Phone number for SMS-based account verification and recovery.
- Billing information processed by our payment provider (Stripe). We do not store full card numbers on our servers.
- Usage information generated by your interaction with the Service: production records, compensation data, customer/policy data you enter, and similar operational data necessary to provide the platform.
- Technical information automatically collected when you access the Service: IP address, browser type, device information, and access logs.
3. How We Use Information
- To provide and operate the Service for you and your agency.
- To authenticate your account and verify your identity (including via SMS verification codes).
- To process payments and manage your subscription.
- To send transactional communications: account verification, security alerts, billing notices, and service-related updates.
- To improve the Service, troubleshoot issues, and monitor security.
- To comply with legal obligations and enforce our Terms of Service.
4. SMS Messaging
SMS use disclosure. Acumenly uses SMS messages for account verification only. When you provide your phone number during signup, we send a one-time verification code (OTP) to confirm ownership of the number. We may also send SMS for account-recovery flows that you initiate. SMS messages from Acumenly are transactional only; we do not use SMS for marketing.
Message frequency. Typically one verification message per signup or recovery event. There is no recurring or promotional SMS volume.
Carrier costs. Message and data rates may apply. Acumenly is not responsible for charges your wireless carrier may impose for messages sent or received.
Opting out. You may opt out of SMS by replying STOP to any message. Replying HELP returns contact information. Opting out of verification SMS may prevent you from completing signup or recovering your account; in that case, contact admin@acumenly.com for alternative verification.
Mobile information sharing — restriction. We do not share or sell your mobile phone number or SMS opt-in information with third parties or affiliates for marketing or promotional purposes. Mobile information collected for SMS verification is treated as separate and confidential. No category of information described elsewhere in this Privacy Policy (including the "How We Share Information" section below) includes mobile information collected for SMS verification — that data is handled only by our SMS delivery provider (Twilio) for the sole purpose of transmitting the verification code to your device.
5. How We Share Information
We share information only as follows:
- Service providers who help us operate the platform, including: Supabase (authentication and database), Stripe (payment processing), Twilio (SMS delivery), SendGrid (email delivery), and Microsoft Azure (hosting). These providers process information on our behalf and are bound by data-processing terms.
- Within your agency. Information you enter into the Service is visible to other users of your agency's account in accordance with their permissions.
- Legal requirements. If required by law, court order, or to protect our rights, users, or the public.
- Business transfers. If Acumenly is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.
We do not sell your personal information.
6. Data Security
We use industry-standard safeguards including encryption in transit (TLS) and at rest, role-based access controls, multi-tenant row-level security on our database, and routine security review. No system is perfectly secure; please notify us promptly at admin@acumenly.com if you believe your account has been compromised.
7. Data Retention
We retain account and operational data for as long as your agency has an active subscription, plus a reasonable period afterward for legal, accounting, and dispute-resolution purposes. You may request deletion of your personal information at any time by contacting admin@acumenly.com, subject to retention requirements that apply by law.
8. Your Rights
Depending on your jurisdiction, you may have the right to: access the personal information we hold about you; correct inaccuracies; request deletion; object to or restrict certain processing; and request portability. To exercise these rights, contact admin@acumenly.com.
9. California Residents (CCPA/CPRA)
If you are a California resident, you have additional rights including the right to know what personal information we collect, the right to delete personal information, the right to correct inaccurate information, and the right to opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined under California law.
10. Children's Privacy
The Service is intended for use by businesses and their authorized personnel. We do not knowingly collect information from individuals under the age of 13. If you believe we have collected such information, contact us and we will delete it.
11. International Users
The Service is operated in the United States. If you access the Service from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country.
12. Changes to This Policy
We may update this Privacy Policy from time to time. We will indicate the date of the latest revision at the top of this page and, for material changes, provide additional notice (such as via email or an in-product notification).
